Earlier this month, their efforts were rewarded. They represented two people who had been pulled over by police for leaving the vicinity of a party at what “appeared” to police to be a high rate of speed. The police had been alerted to the party after shots had been fired.
Despite the fact that the individuals suspected of firing the shots were described as being Hispanic and driving a black car and clients were Asian and driving a white car, the police conducted a felony traffic stop, removing the clients and a third party from their car at gunpoint.
The police searched the car and uncovered two guns. Both clients were charged with possession of a gun and driving a vehicle with a gun inside the car. Both clients faced a possible lengthy prison sentence.
Greenberg, Greenberg & Kenyon filed a motion to suppress the evidence because the police did not have probable cause to support the search of the car without a warrant. The court agreed and the case was dismissed for lack of evidence.
